On Friday, the Supreme Court of Canada released its judgment in R v Morrison, which struck down certain parts of the child luring offence in the Criminal Code. In its analysis, the Court relied upon the work of Bottos Law Group Associate Counsel Peter Sankoff, citing his book Manning, Mewett and Sankoff: Criminal Law, 5th ed. at several junctures as authority for the law on mental elements and how reasonable steps should be interpreted. Peter’s book was actually relied upon – albeit at different places – by both the majority opinion of Moldaver J and the dissenting opinion of Abella J.
